Sub-Policy: Privacy Statement for Job Applicants

Scope & Introduction

As part of any recruitment process, PTC Inc. and its Affiliates (“PTC,” “we,“ “our,” or us”) collect and process Personal Information relating to job applicants.

We respect the privacy rights of individuals and are committed to handling Personal Information responsibly and in accordance with all applicable privacy and data protection laws. This Statement sets out the Personal Information that we collect and process about you as you apply for a job at PTC.

This Statement sets out how and why your Personal Information will be used and how long it will usually be retained. This Job Applicant Privacy Statement is supplemental to PTC’s Privacy Statement, which provides details of PTC’s processing of Personal Information in circumstances not covered in this Statement, for example, when visiting a PTC facility or signing up for a webinar or training course. PTC’s Privacy Statement also sets out your rights with regard to your Personal Information, and how you can exercise them.

Summary

In sending us your Resume, CV, or applying for a job at PTC, you are allowing us to store all Personal Information that you provide, together with your contact details in our job applicant database and applicant tracking systems.

We will only share your Personal Information with the PTC People Team members, talent acquisition, third-party facilitators and consultants engaged to support the recruitment process, and PTC Interview Panel members for positions that you have applied for or that may be of interest to you for a profile like yours.

We may need to share your Personal Information with external third parties, such as to local labor authorities, courts and tribunals, regulatory bodies and/or law enforcement agencies, for the purpose of complying with applicable laws and regulations or in response to legal process.

We will not keep your Personal Information in our job applicant database for more than 6 months after the end of the recruitment process for the role that you applied for, unless either we are required to keep such information longer by law, or you have agreed (opted-in) to PTC keeping that information for a longer period so that you may continue to be considered for roles that may be suitable.

Where we require a reference check, we will always ask you first before contacting anyone for personal references. Where a background check is required, we will share your Personal Information (Email ID) with a third-party service provider who will support this. More information about the background check process and the types of information processed will be provided if a background check is required for in accordance with PTC’s Background Check Policy, available on request.

Privacy statement for Job Applicants

Effective: January 1, 2024

1. What Personal Information do we collect when you apply for a job at PTC?

In connection with your application, we will collect, store, and use a range of information about you. This includes:

  • the information you have chosen to provide in your Resume/CV and/or cover letter and on your application, including your name, title, address, and contact details, including email address and telephone number, date of birth, and gender, together with details of your qualifications, skills, experience, and employment history;
  • information about your entitlement to work in the country where you are applying;
  • any information you provide to us during an interview;
  • results of skills and aptitude assessments; and
  • information about remuneration.

Where it has been agreed that any expenses that you incur in attending an interview will be reimbursed, we will collect certain financial information from you to enable that reimbursement.

We may also collect and process the following “special categories” of more sensitive Personal Information that you may choose to provide:

  • equal opportunities monitoring information, including information about your ethnic origin, sexual orientation, health, and religion or belief; and
  • disability information so that we can make reasonable adjustments during the recruitment process.

We collect this information in a variety of ways and from various sources. As noted above, Personal Information might be contained in application forms, Resumes/CVs, either obtained directly or through a third-party recruitment service, or that you have chosen to share on a public forum for the purpose of finding a job. We may also obtain Personal Information from your passport or other identity documents or collected through interviews or other forms of assessment such an online test.

Where we require a reference and/or background check, we will also collect Personal Information about you from third parties. Background checks are carried out by third parties on our behalf, and we will inform you that we are seeking a background check and sharing your email ID with the service provider which will then contact you directly. We will let you know before we ask for a reference or a background check.

Personal Information will be stored in a range of different places, including on your application records, personnel file, Applicant Tracking System, in HR management systems, and on other IT systems (including email).

2. How do we use your Personal Information?

We will use the Personal Information we collect about you to:

  • assess your skills, qualifications, and suitability for the role;
  • conduct reference and background checks;
  • communicate with you about the recruitment process;
  • keep records related to our hiring processes; and
  • comply with legal or regulatory requirements.

We will use the Personal Information you provide to us to determine whether your application is strong enough to proceed to the next stage of the recruitment process. If we decide to offer you the role, we will then take up references and perform background checks before confirming your appointment.

3. What if you do not provide Personal Information?

If you chose not to provide information when requested, which we consider necessary for us to consider your application (such as evidence of qualifications or work history), your decision not to provide certain information will impact our ability to assess your suitability for the role, and we may not be able to process your application. For example, we require references for this role and you fail to provide us with relevant details, we will not be able to take your application further.

4. Who has access to your Personal Information?

Your information will be shared internally within PTC for the purposes of the recruitment exercise. This includes members of the People and Talent Acquisition Teams, hiring managers involved in the recruitment process, managers in the business area with the vacancy and IT staff if access to the data is necessary for the performance of their roles. We may also share your information with hiring managers involved in the recruitment of other roles which might suit your skill set and experience.

We will only share your data with third parties where it is strictly necessary as part of the recruitment process. For example, PTC uses online assessment tools which are hosted by a third-party service provider, and for certain roles, there may be a requirement for a background check to be carried out, in which case your contact details will be shared with the third-party service provider. If you or PTC have been working with a recruitment consultant or agent, then certain information shared during the recruitment process may be shared with them.

Your information may be shared with regulatory bodies, government bodies, and agencies or courts and court-appointed persons where we are obliged to do so in compliance with a legal obligation or regulatory obligations.

5. How do we protect your Personal Information?

We take the security of your information seriously. We have internal policies (such as our Cybersecurity Policies) and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties. We have put in place procedures to deal with any suspected cybersecurity breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so. All of your data will therefore be held securely and processed only by those who use your data for the purposes of the recruitment process as referenced above.

6. How long do we keep your Personal Information for?

Successful applicants

If your application for employment or engagement is successful, Personal Information gathered during the recruitment process will be transferred to our Employee Management System, retained during your employment, and destroyed after your employment ends in accordance with our Employee Data Retention Policy.

Unsuccessful applicants

If your application for employment or engagement is unsuccessful, we will retain your information 6 months after the end of the relevant recruitment process, unless a longer retention period is required to comply with any legal obligations or for the exercise or defense of legal claims (subject to any applicable legal or regulatory obligations to retain such information for a longer period). We may ask if you would like your information to be kept for an additional period so that PTC can keep in touch with you, and you can be considered for other roles at PTC. You can withdraw your consent at any time, and PTC will delete your Personal Information from our systems, except where we are required to keep it for legal reasons.

7. Automated decision-making

Automated decision-making does not form any part of PTC’s recruitment process.

8. International transfers

PTC is a global company, and as such, Personal Information may be accessed anywhere in the world. If you are communicating electronically with us, various communications will necessarily result in a transfer of information across international boundaries. Accordingly, by communicating electronically with us your Personal Information may be processed in a country other than the one in which you reside. The transfer of Personal Information between PTC’s Affiliates is governed by a Global Data Transfer Agreement based on the EU Standard Model Clauses.

9. Legal Basis for processing your information for EU, UK, and Swiss applicants

There are a number of legal bases under which PTC may process your Personal Information (in compliance with certain data protection laws such as the EU’s GDPR):

  • We need to process your Personal Information to decide whether to enter into a contract of employment or engagement with you.
  • We also have a legitimate interest in processing Personal Information during the recruitment process and for keeping records of the process. Processing data from you allows us to manage the recruitment process, assess and confirm your suitability for employment, and decide to whom to offer a job. We may also need to process data from you to respond to and defend ourselves against legal claims.
  • In some cases, we need to process data to ensure that we are complying with our legal obligations. For example, we are required to check your eligibility to work in the country where the role you are applying for is located, if you’re successful, before your employment starts.
  • We process health information in order to consider whether to make or provide reasonable adjustments during the recruitment process, for example, whether adjustments need to be made during a test or interview, in compliance with our obligations under employment, Social Security, and social protection law.
  • We process information about your ethnic origin, sexual orientation, health, or religion or belief, to ensure meaningful equal opportunity monitoring and reporting and/or to comply with legal and/or regulatory requirements. Data that the company uses for these purposes will be collected on an anonymized basis. Candidates are entirely free to decide whether to provide such information, and your application will not be affected either way.

10. Your rights in connection with your Personal Information

In certain circumstances, if you are resident in certain jurisdictions, you may exercise the rights available to you under applicable data protection laws. Please see Section 12 of the PTC Privacy Statement for more information about your rights and how to exercise them.

11. Where we store and process data

The information that you provide to us may be collected, transferred, and stored in various locations, including in the United States of America, Asia, the European Economic Area (EEA), or other locations. By submitting your Personal Information, you agree to this transfer, storing, and processing. The transfer of Personal Information from the EEA, UK, and Switzerland is governed by a Global Data Transfer Agreement based on the EU Standard Model Clauses between PTC’s EEA, UK, and Swiss subsidiaries and its non-EU, US, and Swiss Affiliates.

12. Information integrity

You are responsible for the accuracy of all Personal Information you provide to us. Please be sure to update your Personal Information promptly if it changes or becomes inaccurate.

13. Disclosures of Personal Information

We do not share Your Personal Information with others, except as follows: We share your information within PTC and its Affiliates wherever they may be located. We also may share your information with third parties who process the data on our behalf for the purposes set forth in this Policy. We may also share your information as required by law or in the interest of protecting or exercising our or others' legal rights, e.g., without limitation, in connection with requests from law enforcement officials and in connection with court proceedings. We may share or transfer your information in connection with a prospective or actual sale, merger, transfer, or other reorganization of all or parts of our business. Finally, we may also share your Personal Information where you have granted us permission.

14 How do we protect Personal Information?

Transmissions over the internet are never 100% secure or error-free. However, we take reasonable steps to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. 15. Amendments

We reserve the right to change this Policy from time to time and in our sole discretion. We will alert you that changes have been made by indicating on the Policy the date it was last updated. When you use the service, you are accepting the current version of this Policy as posted in the app at that time.
